A mother who was told by a judge that she should have taken more care when driving after being involved in a road accident, has won a large payout in compensation from West Sussex County Council, it has been revealed.
After swerving off the road from skidding on an icy patch, the driver, a 53 year old woman from Surrey, had managed to get the vehicle back onto the road but due to an uneven verge, the car was forced off the road when it collided into a tree.
As a result, she suffered from severe personal injuries to her head.
Yet according to the judge, the driver was partly to blame for her personal injuries as she was “not driving in a way which was appropriate and safe for the conditions that day.”
However, with the help of her injury lawyer, it was proven that the poor maintenance of the roads was to blame for the accident.
The judge said: "It was plainly reasonable for the verge to be made up to the height of the road when the road height was increased in 2001. There was a duty to maintain that verge."
He added: "The car dropped almost six inches and that is dangerous.”
As a result, she is expected to win a six or seven figure sum due to the extent of her injuries.
